An investigation of the right to life according to the ECHR regime: putative asbestos case

The right to life article is enshrined in the ECHR with the objective of making its implementation practical and achievable, with corresponding duties that are incumbent on the State, clearly delineated. This paper proceeds by establishing the facts of the case and issues instantiated via the proceedings. The focus pivots on showing that it is the Court’s overarching view that procedural obstacles circumventing the realization of the aims of Article 2, are to be mitigated where possible.
