This article revisits the subject of citizenship in the United States by analyzing the most important Supreme Court key decisions in the aftermath of President Donald Trump’s Executive Order n. 14160. After years of civil struggles and judicial precedents that have shaped the history of American constitutionalism, the citizenship right is once again under attack, and the interpretation of the Fourteenth Amendment remains a matter of debate. The final section of the article discusses the views of authoritative scholarship, who have openly supported the idea that all persons born on American soil are American citizens by birthright.
